Premium Chess, FIDE and Federation arenas

I hereby declare that I have read, understood and accept the regulations, and membership, privacy and use of data procedures, and the disclaimer contained on this page.

Regulations, Privacy and Use of Data
It is of the utmost importance that Premium Chess online arenas provide a pleasant and secure environment for player and observer alike. The following regulations have been formulated to guarantee that the highest possible ethical standards and conduct are maintained.
In order to become guest or full members of a Premium Chess arena, membership applicants are required to declare that they have read, understood and accept the following text regading key regulations and privacy policy.
Note that at anytime, members have the right to revoke permission to use and process data. (See Clause 14.5, Revocation and data deletion, in the Privacy section).

These regulations must be strictly adhered to at all times by all users of Premium Chess online arenas:

1) PLAYER CONDUCT
All Premium Chess online arena full and guest members must conduct themselves ethically.

1.1 Cheating
Players are not permitted to engage in any unfair game practices such as using software assistance, consulting other people while playing, allowing substitute players to share their account or the deliberate lowering of ratings (sandbagging). There is zero tolerance of such conduct, which is quite clearly cheating. The sophisticated ACE-Guard™ anti-cheating system monitors every single game played between two full members and analyses all performance trend variations with extreme precision. Any evidence of cheating and suspicious performance alteration is automatically reported to the Site Administrator, who then decides on the appropriate course of action or penalty.

Each full member is awarded a Fairness Index Rating, which is expressed as a scale of 1 to 5 stars of different colours.

To further guarantee the highest possible standards, our Anti-Cheating Team constantly monitors tournaments and individual challenge games for regulation violation. The team is made up of highly qualified information technology and anti-cheating specialists, chess masters and legal experts. Their responsibility is to evaluate violations and together with the Site Administrator decide on the appropriate action to take against an offender.


1.2 Chat
Exchanging chat messages with other players can be fun as well as informative. However, it is fundamental that all chat be of a cordial nature; the use of unacceptable language is a clear violation of Premium Chess online arena regulations.
The following are strictly forbidden:
• the use of insulting, offensive language, swear words, and obvious euphemisms or code words
• the use of obscene, racist or intimidating language or comments of an offensively personal nature
• inappropriate or offensive remarks directly to or regarding Premium Chess online arena or its staff

In addition, members are not allowed to make accusations of cheating to the player concerned or to any other party. Usually such accusations are unfounded. In addition, without the complete games record and other information that are available to our anti-cheating team it is impossible for a member to know if cheating has occurred or not. Members are requested not to report suspected cases of cheating to online arena staff as every single game played by members is monitored by the anti-cheating system.

To assist in the monitoring of chat abuse, the system records all chat messages.

1.3 Deliberately annoying activities and harassment
Members are forbidden from deliberately annoying other members, e.g. making repeated challenges after initial challenges have been refused.

1.4 Misleading, inappropriate or offensive usernames

Members are prohibited from registering usernames that could create reasonable confusion as to identity (e.g. suggest that a member is an administrator, member of FIDE staff, other member, famous or titled player, etc.); that promote or advertise other playing sites or commercial activities of any sort; that are offensive or obscene (e.g. racist, sexist, offensive to religious beliefs, sexual, etc.), or that clearly refer to or suggest offensive or obscene words or concepts; or that are clearly likely to offend or insult other members and disrupt normal procedures. Decisions regarding if a username is offensive or not are not subject to appeal or discussion.

2) PENALTIES FOR BREACH OF REGULATIONS
Premium Chess reserves the right to take all appropriate measures in response to any breach of regulations. In the event a player has been found to be in violation of tournament or challenge game regulations, Premium Chess online arena staff will either warn the player in question, or immediately suspend membership for a limited period of time, or annul his or her membership.
All decisions and penalties regarding any breach of regulations are final and not subject to appeal or discussion.
In the event of one or more clear violations of Premium Chess online arena regulations, a user’s membership can be suspended or annulled with immediate effect at any time. As members agree to abide by Premium Chess online arena regulations when applying for membership, no partial or full refund of membership fees shall be made when a membership is annulled because of breach of regulations. If any conduct or activity by user is in breach of applicable laws, the relevant authorities shall be informed as required by law.

2.1 Cheating
Cheating is one of the most serious breaches of Premium Chess online arena regulations and can result in immediate membership suspension or annulment. When membership is annulled because of cheating, all association by that member with the arena may be cancelled, future membership could be prohibited, and the member in question could be banned from participating in Premium Chess online arena competitions and FIDE or federation over-the-board events for a period of time to be determined. As there is no distinction between ratings for blitz or rapid games played on FIDE online arena and over-the-board, all FIDE sanctions for cheating apply to full members of FIDE online arena.

2.2 Chat
Premium Chess takes all chat misconduct very seriously, and it will take quick action any time it occurs.
Premium Chess reserves the right to temporarily or permanently withdraw a member’s chat service, and, in serious cases of misconduct, suspend or annul membership. Such decisions are final and are not subject to subsequent discussion or appeal.

2.3 Fairness Index
Premium Chess reserves the right to change the Fairness Index rating of any player considered to be in breach of regulations, in particular in regard to the completely prohibited use of software assistance or substitute players.

2.4 Premium Chess online ratings.
Premium Chess reserves the right increase, decrease or annul a member’s player performance rating, in particular as a penalty for using software or account sharing or other forms of cheating.

2.5 Game fairness evaluation
Premium Chess reserves the rights to evaluate if any conduct unfairly compromises a game and take appropriate penalty actions.

2.6 Administrator and technical support
Premium Chess reserves the right to suspend or annul membership in the event of a breach of administrator or technical support staff regulations

2.7 . All decisions regarding cheating and resulting action taken are made by PremiumChess staff and are not subject to subsequent discussion or appeal.

3) INTERNET CONNECTION AND DISCONNECTION
Premium Chess accepts no responsibility for any problems caused by the instability of a user’s Internet connection or originating from his or her computer. Our server continuously monitors each player’s connection and records any instability that occurs.

A player loses a game if they voluntarily disconnect their computer or log off while a game is in progress. If disconnection occurs involuntarily as a result of connection problems, the system will try to re-establish the connection with the player, who – if play resumes – loses the time taken to do this. After several unsuccessful reconnection attempts or the passing of an excessive amount of time without a connection, the player loses the game. No protest, claim, or game replay request will be accepted in the event a user has problems with his or her Internet connection or computer during the course of a game or tournament.

It is completely impossible to change your own or your opponent’s remaining playing time during the course of any game played on Premium Chess online arenas. This is because playing time is automatically managed and calculated by our server, and not by a player’s computer, which receives all playing time information from our system. Any lag in either player’s computer is detected by our server, which then makes the necessary adjustment to the time displayed on the players’ computers to compensate for the lag (i.e. the arena server and players’ clocks are synchronized).

4) RESOLUTION OF PROBLEMS RELATED TO TECHNICAL MALFUNCTIONS
It is extremely rare that malfunctioning technology creates any serious problems and the vast majority of games and events proceed smoothly. Premium Chess does not accept any responsibility for any problems related to Internet speed, connection quality or interruption unrelated to our server, as these are completely beyond our control.
The information that is exchanged between our server and a user’s computer passes through an enormous number of nodes, i.e. connection points that are completely independent and separate from Premium Chess online arenas and the user’s Internet provider.
Members are advised to consider obtaining an alternative means of connecting to the Internet, so that they can reconnect quickly in the event there is a problem with their principal means of connection.
In the very rare event that there is a problem with the Premium Chess server, all connected players are affected and the problem is immediately apparent to Premium Chess online arena staff and all players online.
Problems can be caused by the members’ computers or how they are configured. Where possible we can supply limited assistance as to possible remedies. However, in many cases it could be advisable for the members to consult their personal computer technician.
If there are problems directly connected with the Premium Chess online arena server that cause an interruption to the supply of games management services, all tournament and challenge match games in progress will be annulled. Upon the resupply of games management services, all games that were annulled because of service interruption will be replayed from the beginning (not from the position at the time of service interruption!) All results before service interruption remain valid.
If any interruption in the supply of games services caused directly by Premium Chess’ server lasts for a time period longer than 30 minutes, or it is impossible to restore an event or events, the Games Manager has the right to cancel, annul or terminate a tournament as follows:
• Tournament in the registration phase: the tournament is cancelled
• Tournament in progress: the tournament is manually terminated by the Games Manager (games in progress will be annulled) and there will be a roll forward, namely:
• If the 1st round has not been completed, the tournament will be annulled.
• If a minimum of 1 round has been completed, all games in progress will be annulled, and the standings table after the last round completed before service interruption will be considered to be the final standings.

5) TOURNAMENTS AND CHALLENGES

5.1 Tournament registration
To register for a tournament, first look at the Sit & Go or Tournaments window; when you see Registering in the column for any particular tournament, you can join that tournament by simply clicking on the Register button. Tournament registration can be cancelled by clicking on the Cancel Reg button.Tournament registration cancellation is allowed until one minute before the start of the tournament. If a registered player is disconnected at the time a tournament starts, he or she will still appear on the tournament schedule, and can participate in future rounds on reconnection. It is the responsibility of the player to be available for play when a tournament begins. If the participant is not available to play when a tournament game begins, he or she will forfeit the game, which is recorded as a loss. Should a participant forfeit two consecutive tournament games, he or she will automatically be expelled from the tournament. If a participant withdraws from a tournament, 20 rating points will be deducted from his or her PremiumChess online rating at the end of the tournament in question.

5.2 Challenge games and matches
A challenge game is when one member challenges another member, a selected group of members, or all members to a single game; a challenge match is when one member challenges another member or group of members to a series of games: the player who issues the challenge is automatically registered for the event.
The challenger can cancel the challenge if it has not it been formally accepted by another player.
A challenge game or match becomes a registered event as soon as the negotiation stage is concluded and the opponent formally accepts the challenge. From this point on, the agreement of both participants is required before the event can be cancelled.


5.3 Player pairing procedure
All tournaments involve successive rounds; in each round every player is paired with an opponent. PremiumChess pairing methods are used. Pairing is determined by the rating difference between participants, and the players’ position in the tournament standings table. More precisely, for a round-robin or knockout tournament, pairings are done at the beginning of the tournament for all the rounds; whereas for a Swiss-system tournament, pairing is done at the beginning of each individual round. For specific information, players should consult the pairings and standings tables in the appropriate tournament room in the Lobby area.

5.4 How tournament and challenge game/match results are determined
There are only three possible results for a tournament, challenge or challenge match game: a win, a draw or a loss.
If at the end of any challenge match there is no winner, the winner of the event is decided by the result of an Armageddon game. PremiumChess online rating change is calculated using the final result of a challenge match or tournament and not on a game-by-game basis.
For tournaments, the final standing results are governed by the rules of the tournament in question. In the event of a tied result, one or all of various tie-break methods are used to determine the winner. A player can resign a game at any time, giving his opponent a full point for a win. In the event a player withdraws from the tournament itself, he or she will not participate in successive rounds and will be excluded from the final standings.

 

6) TIME CONTROLS

For the purposes of Premium Chess online arenas:

A 'bullet' game is one where all the moves must be completed in a fixed time of less than 3 mins or the allotted time plus 60 times any increment is less than 3 mins.

A ‘blitz’ game’ is one where all the moves must be completed in a fixed time of 10 minutes or less (but over 3 mins) for each player; or the allotted time plus 60 times any increment is 10 minutes or less.

A ‘Rapidplay’ game is one where either all the moves must be completed in a fixed time of more than 10 minutes but less than 60 minutes for each player; or the time allotted plus 60 times any increment is of more than 10 minutes but less than 60 minutes for each player.

 

7) PREMIUM CHESS ONLINE ELO RATINGS
Numerical Premium Chess Elo ratings indicate a chess player's ability and performance; full members can have as many as four different online ratings. With the exception of FIDE online arena (there are single individual official FIDE online ratings for blitz and rapid), there are three official online ratings obtained on Premium Chess online arenas: one for bullet , blitz and rapid; these ratings are only for games played with other full members, all of which are monitored by the ACE-Guard™ anti-cheating system. In addition, there is a single unmonitored rating that merges performance in all time controls for games played with guest members (these games are not monitored by the anti-cheating system). Guest members have only the single unmonitored rating. In open tournaments a player with any rating can participate, whereas in closed tournaments only players within a certain rating band can participate.

For the first 4 games played by full members, there is a rating establishment process for the three available time controls of bullet, blitz, and rapid(for FIDE online arena only for blitz and rapid). Once a full member has played 4 games with full members with ratings, he or she will be assigned an official rating based on the results and ratings of the opponents.
An unmonitored ratings are given to both players for games that involve one or two guest members; these games are not monitored by the anti-cheating system. There is no rating establishment procedure for unmonitored ratings and a member’s initial unmonitored rating is 1800 regardless of the type of membership he or she has.
The rating of every player is subsequently recalculated on the basis of his or her tournament, challenge game or challenge match results. This calculation incorporates a K-factor adjustment that is designed to ensure that rating changes are not inappropriate. All players (except guest members) are awarded official FIDE or national federation ratings;

8) GUEST MEMBERS
Premium Chess online arena guest members are subject to all regulations:

8.1 Guest membership registration
During guest membership registration, the applicant must provide his or her own e-mail address, his real name and surname, submit a member nickname, with which he or she will later be identified in the Lobby and elsewhere; and choose a password, which will be used with his or her nickname to gain access to the system.
The password is known only to the member; in the event it is forgotten, the system can be requested to automatically resend it to the member’s own e-mail address, which is given at the time of registration. A complex and difficult-to-guess password should be used so as to avoid improper use of a membership by others.

8.2 Guest upgrade to full membership
When a guest member decides to upgrade to full membership, further registration takes place. Once this upgrade registration process is completed, a guest member becomes a PremiumChess online arena full member and is able to participate in official Premium Chess online arena tournaments, receive official FIDE and/or national federation online ratings and classifications, and enjoy all the rights, advantages, and fun that full membership offers.

9 ) FULL MEMBERS
Full members or users who pay for specific services must provide certain data, such as address and, when required other data such as, banking details, credit card numbers, Premium Chess, FIDE and/or national federation ID number, telephone number, etc.
As is the case for all FIDE and federation over-the-board events, the names and surnames of Premium Chess online arena full members participants are freely available to other players or observers. (see Privacy for more details)


10) USERNAME CHANGE AND MEMBERSHIP CANCELLATION

For legal, administrative and technical reasons, Premium Chess online arena guest membership usernames cannot be changed or annulled under any circumstances. If a guest member no longer wishes to use their account, they can simply discontinue using the arena. A Premium Chess online arena full member’s nickname cannot be changed or modified under any circumstances. If a full member wishes to cancel their membership they must send an e-mail requesting this to the appropriate arena customer support email address. At anytime the sending of online arena information email messages and newsletters can be cancelled by writing to info@premiumchess.net, stating username and the email address to which the online arena information email messages and/or the newsletters are being sent. Email and newsletter delivery cancellation can also be done using the cancellation link contained in each newsletter.


11) ARENA SERVICE ACCESS
Game services are accessible at the times and dates published.
PremiumChess reserves the right to temporarily disrupt services for necessary site maintenance and organisational work. In this event, all challenge games, challenge matches and tournaments in progress will be annulled, with issues regarding classification, rating, prizes, etc, being resolved in the same way as when there is a disruption in services created by a malfunction of our server (see 4 above).
Players have access to detailed information regarding all events they have participated in the Lobby section of their arena.


12) INFORMATION ACCESS
Regulations, how to play instructions, calendars, schedules, times and dates of service access, and all other information regarding events are readily available in the Lobby and elsewhere on the various arenas.

 

13) ADMINISTRATOR AND TECHNICAL SUPPORT

Premium Chess online arenas supplies excellent arena administrator and technical support for its members. The well being and protection of support staff is of the utmost importance. Therefore, the following will not be tolerated:
inappropriate or abusive language
persistent repetition of an answered query
inappropriate comments regarding administrators or technical support staff

Note that queries and requests for information must be reasonably short and clear.

PREMIUM CHESS online arena does not allow its administrators or technical staff to give out their names or other personal details.


14) PROCESSING OF PERSONAL DATA
By registering as a full or guest member, each user agrees to allow Premium Chess to process and use personal data in accordance with Premium Chess online arena procedures as allowed by applicable laws (see the Privacy page)

PRIVACY, COLLECTION AND USE OF DATA.

Premium Chess in the management and operation of FIDE online arena and its national chess federation online arenas (hereafter referred to as Website/Websites) is completely committed to protecting the privacy of its users when acquiring and processing personal data for all its administration and business procedures. Premium Chess observes applicable data protection laws. Premium Chess’s data protection provisions apply to all services offered on websites operated by Premium Chess as well as to its portals and to all online game related activities on the Websites but not to pages belonging to other providers to which the Websites provides links. In such cases, the data provisions and conditions of the respective websites shall apply.
At any time, users have the right to revoke permission to use data. (See Clause 5, Revocation and data deletion).
If users have any questions as to how Premium Chess processes and uses their personal data, they should contact us. (See Clause 6, Data protection and contact information).

14.1 Collection and use of personal data by Premium Chess

14.1.1 In terms of most data collected, users remain anonymous when visiting the Websites. Inevitably, any file retrieval and access by a Website user always involves access data collection, which in the case of Premium Chess is stored without reference to a specific person/user as follows: Internet Protocol, address / IP address, page from which the file was requested, date, time, browser type and operating system, the page visited, transferred data quantity, access status (file transferred, file not found, etc.). This data may be used to generate statistics which help Premium Chess to adapt and improve its services.

14.1.2 Almost always, Premium Chess only accesses and utilises data provided by users for initial guest and full membership registration, and if services subject to a charge are requested or performed. The only data required at initial registration for guest members is a user name, name, surname and an email address. More data is required for full membership registration.

14.1.3 Full members or users who pay for specific services may be required to provide further data, such as address, banking details, credit card numbers, etc. Full members or users who pay for specific services may also be required to provide a Website, FIDE or Federation ID number, email address, telephone number, etc. Premium Chess will treat this data in the strictest confidence and in accordance with applicable data protection laws. Premium Chess will not give user data to a third party without the user’s authorisation other than to the extent required to perform the requested operation. More details regarding the passing of data to third parties can be found in Clause 3, Passing personal data to third parties.
Premium Chess web services can be accessed via Facebook. When registering via Facebook, users are able to select what information they will share with us.

14.1.4 As is the case for all FIDE and national chess federations over-the-board events, the names and surnames of Website full member players are freely available to other players or observers.

14.1.5 Children
Clearly, special protection is required for children. To become members, children under the age of sixteen (16) need to have the express approval of a parent or guardian who is at least 18 years of age and who in granting such approval is also making a commitment to monitor the child's usage of the Website.
It is the parent or legal guardian’s responsibility to determine that all areas of the Website and its services and activities are appropriate for the child under their protection.


14.1.6 Inventory data, utilisation data and statement data is collected, processed and used by PremiumChess only to the extent that is required. Premium Chess reserves the right to store IP addresses and log files for a reasonable period of time after website user access in order to monitor whether the user has complied with Website terms, conditions, regulations and game rules, to ensure proper authorized payment processing and for anti-cheating monitoring. In the event of illegality or wrongdoing, relevant data will be given to the appropriate authority as required by applicable law. Otherwise, as far as is possible, any other data is processed anonymously.

14.1.7 Ancillary Information
Each time a user is logged on to a Website, the following information is recorded in a permanent log:
- the username
- IP connection number
- connection and disconnection time
- the ID of the computer (Machine ID) used to access the Website
Machine ID allows it to be determined if two sessions were played on different computers or not. In addition, the Website’s client program registers when a user switches from the client program to some other program and vice versa. The Website’s client program can also detect whether a chess program is running on a user’s computer while they are playing an event. This information is necessary for the single purpose of determining if users are improperly using a chess engine to gain an unfair advantage when playing. Only the Site Administrators and a small number of anti-cheating staff have access to this information.
PREMIUM CHESS’s software does not monitor any activity nor access any data from a user’s computer that is not chess related or essential for the correct technical operation of the Website.

14.1.8 At its own initiative or at your request, Premium Chess can complete, correct or delete incomplete, incorrect and/or outdated personal data which Premium Chess stores in connection with the operation of Websites.

14.1.9 PremiumChess deletes personal data at the authorised user`s request, provided such deletion is not contrary to Website regulations or applicable law.


14.2. Data security

14.2.1 At all times Premium Chess takes all reasonable precautions to prevent unauthorised access and misuse of user data. Nevertheless, it is technologically impossible to completely guarantee that unauthorised data access does not occur, and, therefore, Premium Chess does not accept legal responsibility or liability for any consequences that may result from such unauthorised access (See the disclaimer (15) below)

14.2.2 All Premium Chess employees are obliged to comply with applicable data secrecy and data protection laws and are duly informed of their legal responsibilities. In the event of payment transactions, the purchaser’s data is encrypted and transferred using the SSL process.

14.3. Passing personal data to third parties

14.3.1 Usually Premium Chess only passess personal and/or billing-related data to third parties (i.e. to partner companies, other companies cooperating with Premium Chess, external service providers and investigative authorities) as far as this is required to fulfil the agreement and for the aforementioned purposes, in particular for payment processing, the protection of other users, or as required by applicable law. Payment processing takes place via external service providers (e.g. credit card companies, banks, PaySafe, Paypal, and Global Collect). External service providers are obliged to treat your data confidentially and securely and may only use your data as far as this is required to complete the transaction and the necessary fulfilment of their duties. It is important to note that in some circumstances Premium Chess may be legally obliged to pass on data (e.g. to investigative authorities).

14.3.2 With the exception of the cases in 3.1, Premium Chess will not pass on user personal data provided to Premium Chess during membership registration and its processing unless users give their express approval.

14.4. Data provision and access changes

Premium Chess reserves the right to alter data protection provisions or change access authorisation or deny access to the pages where data is displayed. Premium Chess will use suitable means to inform affected parties of such changes.

14.5. Revocation and data deletion

14.5.1 At anytime a user can cancel the sending of Premium Chess information email messages and newsletters by writing to PremiumChess at privacy@premiumchess.net, stating which arena they are members of, their user name and the email address to which the Premium Chess information email messages and/or the newsletters are being sent. Email and newsletter delivery cancellation can also be done using the cancellation link contained in each newsletter.

14.5.2 At a user’s request, Premium Chess will delete personal information data, unless legal or other obligations to preserve this data do not permit such deletion.

 

15) FIDE online arena and Premium Chess: proof of identity

FIDE Arena and Premium Chess has the right to request specific proof of identity (e.g. passport, ID card, etc.) from any member for verification purposes directly related to FIDE or FIDE online arena and its activities (e.g. prizes, awarding of titles, suspicion of cheating). If the member fails to comply with a request for identity verification, FIDE Arena has the right to withhold its services, prizes, awarding of ratings, titles, etc and/or suspend or cancel paid membership of FIDE online arena and/or FIDE online arena services until the requested proof of identity is supplied.

16) FIDE online arena procedure alignment
As the awarding of FIDE ratings is subject to FIDE and national federation policy and arrangements relevant to the awarding of such ratings at any given time, FIDE online arena procedures will change when necessary so as to be in accordance with such policy and arrangements

17) Data protection and contact information
Users are always entitled to request information about any user data related to them that Premium Chess has stored, as well as its origin and the purpose for which it was collected. If a user has any questions about data protection or wishes to correct, deny access to, delete or modify their user profile or any personal data, or if they wish to revoke a granted authorization regarding the use of user data or e-mail addresses, they should contact Premium Chess at the following address, providing their user name and e-mail address

18) DISCLAIMER

The materials and services at and connected to Premium Chess online arenas are provided "as is" without any express or implied warranty of any kind. To the maximum extent permitted by applicable law, Premium Chess excludes liability for the unavailability or interruption of any of its services or any features thereof, for any errors or omissions from its services or products, and for any loss, claim, damages or any special, consequential, incidental, exemplary or punitive damages (whether direct or indirectly incurred) of any kind arising out of or in connection with any visitor's or user's access to, or use of, Premium Chess online arenas or related services and activities, or any material thereon, whether based in contract, tort or whether negligent or otherwise, even if Premium Chess has been advised of the possibility of such damage.
Premium Chess does not warrant the content, accuracy or veracity of any material or other information on its arenas nor does it warrant that its arenas are free from errors, faults, viruses or other computer or data-corrupting or data-damaging material. Therefore, the use of Premium Chess arenas is at the visitors', members' or users' own personal risk.
